The rules for using Fociter, without sticky fine print. We explain things the way we'd
explain them to you in person.

The app is yours to use — free or with a Plus subscription. You decide when and how.
Plus is billed via Google Play and renews monthly/annually until you cancel. Cancel in 1 tap from your Google Play account.
Your data stays yours. You can delete it anytime — no questions asked.
We don't move your money or access your bank. You log your transactions manually.
We don't allow illegal or abusive use of the app. Prohibited uses below.
1 Acceptance of these terms
By downloading, installing, or using the Fociter mobile application (the
"App"), you agree to these Terms of Service (the "Terms"). If you don't agree to any part,
don't use the App. These Terms form a binding contract between you and Fociter.
If you use Fociter on behalf of an organization (family, team, etc.), you accept these Terms
on its behalf and represent that you have authority to do so.
2 Who can use Fociter
To use the App you must:
Be at least 13 years old (or your country's minimum digital consent age — 16 in most of the EU).
If you are a minor under your country's law, have a parent's or legal guardian's consent.
Not be barred from receiving the service under applicable law.
Provide truthful account information and keep it up to date.
3 Your account
To access Fociter you create an account via email/password or Google Sign-In. You are responsible for:
The security of your password and any activity in your account.
Ensuring the information you input (habits, transactions, goals) is lawful and doesn't infringe third-party rights.
We may suspend or terminate accounts that violate these Terms, with no refund of remaining
subscription time.
4 Plus subscriptions
4.1 Plans and pricing
Fociter Plus is offered as a monthly or annual subscription. Current prices are shown in
Google Play in your local currency before you confirm the purchase. Pricing may vary by country
and may include taxes depending on your jurisdiction.
4.2 Auto-renewal
Subscriptions auto-renew at the end of each period (month or year) for the
same amount unless you cancel at least 24 hours before the end of the current period. Google
Play charges the payment method on file with your account. Google Play sends an email
notification before each renewal (typically 24–48 hours before for annual subscriptions,
per their policy). If you don't receive the notification, contact Google Play, not
Fociter.
4.3 How to cancel
You can cancel anytime from your Google Play account:
Google Play Store → Your account → Subscriptions → Fociter Plus → Cancel.
You retain access to Plus until the end of the paid period. Cancellation stops future
renewals — it does not generate a refund of remaining time.
4.4 Refunds
Refunds are handled by Google Play under their
refund policy
(auto-refund within the first 48 hours after purchase). After 48 hours, refunds are at
Google's discretion. Fociter does not process refunds directly.
Exception for residents of the EU, UK, Switzerland, and Norway: if local
law grants you a 14-day right of withdrawal for digital services, that right prevails
over Google Play's refund policy. To exercise it, write to
support@fociter.com within 14 days of purchase
and we'll process the refund directly, unless you have already started using the premium
service with your express consent (in which case you lose the right under Art. 16(m) of
Directive 2011/83/EU).
4.5 Price changes
If we change the price of an active subscription, we'll notify you by email and/or push
notification at least 30 days in advance. If you don't accept the new price, you can cancel
before the next renewal at no extra cost.
5 Acceptable use
You agree not to use the App to:
Engage in illegal, fraudulent, or deceptive activities (including money laundering or pyramid schemes disguised as savings circles).
Harass, intimidate, or threaten other users (especially in shared groups).
Upload defamatory, obscene, racist, or IP-infringing content.
Reverse-engineer, decompile, hack, or attempt to bypass technical protections (rate limiting, App Check, security rules).
Use bots, scripts, or unauthorized automation to create accounts or flood the system.
Resell, redistribute, or sublicense access to the App or its features.
Scrape, copy, or extract data belonging to other users.
Engage in commercial data mining, automated scraping, or training of artificial intelligence models with content from the App or from other users.
Violating these rules may result in immediate suspension without refund, content removal,
and/or reporting to relevant authorities.
6 Your content
Everything you input into Fociter (habits, goals, transactions, group names, messages, etc.)
remains yours. You grant us a limited, non-exclusive, royalty-free license to
store, process, and display your content solely to operate the App (sync across devices, show
it to members of shared groups where you added it, generate your personal analytics).
This license terminates when you delete your content or your account. Details on how we do
this in our data deletion guide.
6.1 Your name in shared groups and savings circles
When you participate in a shared group or savings circle (tanda), your username
remains visible to the other members in that group's history, even if you delete
your account. We mark your entry with an "Account deleted" label, but your name stays.
Why do we do this? For safety and trust among group members. In a tanda
or savings group, the other participants need to know who contributed, who received a
cycle, or who paid what — that traceability is what makes participating with real money
viable. If your name disappeared, other members would lose critical context to reconcile
payments and maintain group trust.
What IS deleted when you delete your account: your email, profile picture,
habits, goals, personal transactions, settings, and any data that isn't part of the shared
financial history. Your name only persists within the groups where you participated — not
anywhere else.
7 Fociter intellectual property
The App, the "Fociter" logo, name, visual design (including our neumorphism style), source
code, and all associated materials are owned by Fociter and protected by copyright and
trademark laws. We do not grant you any rights over them beyond use of the App under these
Terms.
8 Privacy
How we collect, use, and protect your data is described in our
Privacy Policy, which forms part of these Terms. We
comply with GDPR, LFPDPPP (Mexico), CCPA, and equivalent laws.
9 Third-party services
Fociter uses third-party services (Google Firebase, Google Play, RevenueCat, Sentry, Google
AdMob — Free plan only) to function. Your use of these services through Fociter is subject to
their own terms. We are not responsible for third-party content, practices, or policies.
10 Warranties and liability
The App is provided "as is" and "as available", without express or implied
warranties. We do not guarantee that the App is bug-free, available 100% of the time, or that
it will meet all your expectations.
Fociter is not financial advice. The analytics, insights, balances, and
projections shown by the App are informational tools — not professional investment, savings,
or tax advice. For important financial decisions, consult a professional.
Savings circles (tandas) are private agreements between you and the group members.
Fociter only provides the software for tracking — we are not custodians of the money, do not
guarantee payments, and do not mediate disputes. Legal and financial responsibility of the
group remains 100% between members.
To the maximum extent permitted by applicable law, our total cumulative liability to you for
any claim related to the App is limited to the amount you paid for the subscription in the 12
months prior to the event giving rise to the claim.
This limitation does NOT apply to (a) damages caused by Fociter's gross
negligence or willful misconduct, (b) breaches of data protection laws where the law
prohibits limiting them, or (c) any other liability that applicable law does not allow
to be excluded or limited.
11 Indemnification
You agree to indemnify and hold Fociter (including our team, contractors, and partners)
harmless from any claim, damage, cost, or reasonable expense (including legal fees) arising
out of your misuse of the App, your violation of these Terms, or your violation of third-party
rights. This indemnification obligation does not apply to claims
arising solely from Fociter's gross negligence or willful misconduct.
12 Termination
You can stop using Fociter anytime — just uninstall the App. To delete your account and data,
follow the deletion instructions.
We may suspend or terminate your access if you violate these Terms, if law requires it, or if
we discontinue the service (we'd give at least 30 days' notice in the latter case). After
termination, sections that by their nature should survive (intellectual property, limitation
of liability, indemnification, governing law) remain in effect.
13 Changes to these Terms
We may update these Terms to reflect changes in the App, in the law, or in our practices.
When we make material changes (affecting your substantive rights), we'll notify you at least
30 days in advance via email or in-app notification. Minor changes (wording clarity, typo
fixes) take effect upon publication.
Your continued use of the App after the effective date means you accept the updated Terms.
If you don't agree, you must stop using the App.
14 Governing law and jurisdiction
These Terms are governed by the laws of the United Mexican States, without
application of conflict-of-laws principles. Any dispute that cannot be resolved in good faith
shall be submitted to the competent courts of Mexico City.
If you live in the European Union, United Kingdom, or another jurisdiction whose laws grant
you non-waivable consumer rights, those rights are not affected by this clause.
Consumers in Mexico may, at their option, file complaints with the
Federal Consumer Protection Agency (PROFECO) for free mediation before
or instead of initiating court action. This right is governed by Mexico's Federal
Consumer Protection Law and cannot be waived contractually.
15 Severability
If any provision of these Terms is held invalid or unenforceable by a competent court,
the remaining provisions remain in full force. The invalid provision will be interpreted
in the manner closest to its original intent that is legally valid.
16 Entire agreement
These Terms, together with the Privacy Policy,
constitute the entire agreement between you and Fociter regarding use of the App, and
supersede any prior agreement (oral or written) on the same subject.
17 Force majeure
Fociter is not responsible for failures or delays caused by events beyond its reasonable
control, including natural disasters, widespread internet or power outages, government
actions, armed conflicts, pandemics, large-scale cyberattacks, or service interruptions
from upstream providers (Google Cloud, Firebase, RevenueCat).
